• Providing Products and Services. We use your personal information to provide you with the Services in order to perform our contract with you, including to process your payments, fulfill your orders, to send notifications to you related to your account, purchases, returns, exchanges or other transactions, to create, maintain and otherwise manage your account, to arrange for shipping, facilitate any returns and exchanges and other features and functionalities related to your account. We may also enhance your shopping experience by enabling Shopify to match your account with other Shopify services that you may choose to use. In this case, Shopify will process your information as set forth in its Privacy Policy and Consumer Privacy Policy.

• Marketing and Advertising. We may use your personal information for marketing and promotional purposes, such as to send marketing, advertising and promotional communications by email, text message or postal mail, and to show you advertisements for products or services. This may include using your personal information to better tailor the Services and advertising on our Site and other websites.

• Security and Fraud Prevention. We use your personal information to detect, investigate or take action regarding possible fraudulent, illegal or malicious activity. If you choose to use the Services and register an account, you are responsible for keeping your account credentials safe. We highly recommend that you do not share your username, password, or other access details with anyone else. If you believe your account has been compromised, please contact us immediately..

• Communicating with You and Service Improvement. We use your personal information to provide you with customer support and improve our Services. This is in our legitimate interests in order to be responsive to you, to provide effective services to you, and to maintain our business relationship with you.

9. Use of Cookies

Like many websites, we use Cookies on our Site. For specific information about the Cookies that we use related to powering our store with Shopify, see https://www.shopify.com/legal/cookies. We use Cookies to power and improve our Site and our Services (including to remember your actions and preferences), to run analytics and better understand user interaction with the Services (in our legitimate interests to administer, improve and optimize the Services). We may also permit third parties and services providers to use Cookies on our Site to better tailor the services, products and advertising on our Site and other websites such as Google Analytics, Facebook Pixel, Instagram, TikTok, and other marketing platforms to collect website usage data and improve our marketing efforts. These services may use cookies and tracking technologies to personalize ads based on your interests. For more information on how these third-party services use your data, you can review their privacy policies. You can manage or disable cookies through your browser settings. Most browsers automatically accept Cookies by default, but you can choose to set your browser to remove or reject Cookies through your browser controls. Please keep in mind that removing or blocking Cookies can negatively impact your user experience and may cause some of the Services, including certain features and general functionality, to work incorrectly or no longer be available. Additionally, blocking Cookies may not completely prevent how we share information with third parties such as our advertising partners.

Our website also recognizes the Global Privacy Control (GPC) signal, which enables you to opt-out of certain uses or disclosures of your information. If you notify us of your preference through GPC, we will treat such signal as a valid request to opt out of sharing / targeted advertising for the associated browser or device, and, if we are able to associate the device sending the signal to a Shopify account, we will apply the opt out request to the account as well. Other than the Global Privacy Control, our website does not respond to Do Not Track (DNT) signals sent by browsers. Since no standard for handling DNT requests has been established, we rely on our cookie policy to manage user preferences. 

10. Device Identifiers

We and our third party service providers automatically may collect an IP address or other unique identifier information ("Device Identifier") for the computer, mobile device, technology or other device (collectively, "Device") you use to access the Site or on third party websites that publish our advertising. A Device Identifier is a number that is automatically assigned to your Device when you access a web site or its servers, and our computers identify your Device by its Device Identifier. For mobile devices, a Device Identifier is a unique string of numbers and letters stored on your mobile device that identifies it. 11. Pixels

In some of our email messages, we may use click through URLs that will bring you to content on our site. We may also use pixel tags to understand whether our emails are read or opened. We use learning from this information to improve our messages, reduce frequency of messages to you or determine interest in content we share.

In certain circumstances, we may disclose your personal information to third parties for contract fulfillment purposes, legitimate purposes and other reasons subject to this Privacy Policy. Such circumstances may include:

If you follow links to sites not affiliated or controlled by us, you should review their privacy and security policies and other terms and conditions. We do not guarantee and are not responsible for the privacy or security of such sites, including the accuracy, completeness, or reliability of information found on these sites. Information you provide on public or semi-public venues, including information you share on third-party social networking platforms may also be viewable by other users of the Services and/or users of those third-party platforms without limitation as to its use by us or by a third party. Our inclusion of such links does not, by itself, imply any endorsement of the content on such platforms or of their owners or operators, except as disclosed on the Services.

We may receive information from third-party partners, including advertisers, retailers, and data aggregators. This information may include marketing and demographic data, analytics information, and offline records. We may also receive information from other companies that collect or aggregate information from publicly available databases or if you consented to allow them to use and share your information. This might be de-identified information about purchasing patterns, location of shoppers and sites that are of interest to our consumers.

15. Social Platforms

You also can engage with our brand, content, applications, and other promotional or events via social media services or other third party platforms, such as Facebook, Instagram, TikTok, or other third-party social media plug-ins. When you engage with our content on or through social media or other third party platforms, plug-ins, integrations or applications, you may provide us with access to certain Information in your profile. This may include your name, e-mail address, photo, gender, birthday, location, an ID associated with the applicable third party platform or social media account or your posts or "likes." For a description on how social media services and other third party platforms, plug-ins, integrations or applications handle your information, please refer to their respective privacy policies and terms of use, which may permit you to modify your privacy settings and/or delete your history. When we interact with you through our content on third party websites, applications, integrations or platforms, we may obtain any information regarding your interaction with that content, such as content you have viewed and information about advertisements within the content you have been shown or may have clicked on.

16. Interest-Based Advertising and Ad Choices

We may use third party companies to serve advertisements, measure the performance and engagement with our ads, provide analytic, preference, and interest information. In some instances, these ad network providers, advertisers, sponsors, and/or analytics service providers may use their own tracking technology to capture information about your device, use and engagement online.

You can opt out of receiving targeted advertising through the Network Advertising Initiative (NAI) Opt–Out Page. Options are Device-specific, so if you use multiple Devices, you should opt out on each one. You can also opt out of certain targeted advertising programs by clicking on the AdChoices icon that may appear on some of our advertising. Some social networks, such as Facebook, allow you to exercise ad choices on that platform. We may use more than one third party company for placing this advertising, which requires opt out of each program. You will still see advertisements while you're browsing online but they may not be targeted to you based on your interests. The NAI Opt–Out Page provides a tool that identifies its member companies that have cookies on your browser and provides links to those companies.

17. Third Parties Providing Services On Our Behalf

We may share information with third party service providers that host or assist with technical operation of our Site, provide analytics, process orders, transactions and payments, provide customer service, loyalty program administration, redemption; or other third parties that participate in or administer our promotions, contests, sweepstakes, surveys or provide marketing or promotional assistance. We may also share non-identifying information, such as aggregate statistics or usage information, with third parties.

18. Your Agreement To Have Your Personal Information Shared

In connection with advertising or our Site, you may be asked to opt–in to receive information and/or marketing offers from someone else, or to otherwise consent to the sharing of your information with a third party, including social networking sites such as Facebook, Instagram, TikTok, etc. If you agree to have your Personal Information shared with a third party, your Personal Information will be disclosed to the third party and will be subject to the privacy policy and business practices of that third party.

19. Children’s Data

The Services are not intended to be used by children, and we do not knowingly collect any personal information about children. If you are the parent or guardian of a child who has provided us with their personal information, you may contact us using the contact details set out below to request that it be deleted.

As of the Effective Date of this Privacy Policy, we do not have actual knowledge that we “share” or “sell” (as those terms are defined in applicable law) personal information of individuals under 16 years of age.

Depending on where you live, you may have some or all of the rights listed below in relation to your personal information. However, these rights are not absolute, may apply only in certain circumstances and, in certain cases, we may decline your request as permitted by law.

• Right to Correct: You may have a right to request that we correct inaccurate personal information we maintain about you.

• charge you a different price or rate for goods or services;

• provide you a different level or quality of goods or services; or

• suggest that you will receive a different price or level of quality of goods or services.

California residents, subject to verification, may request information from us about the information we collect from and about them over the past 12 months, including: 

• the categories of personal information we have collected about you;

• the categories of sources from which the personal information is collected;

• the business or commercial purpose for collecting your personal information;

• the categories of third parties with whom we have shared your personal information;

• the specific pieces of personal information we have collected about you; and

• the categories of personal information we disclosed for a business purpose.

As a California resident, you may access the following personal information by signing into your account:

• your contact information (such as your first and last name, email address, account password, and mailing and billing address);

• your order history;

From there, you can correct, modify, or update that personal information (other than your order history). Please note that deleting any personal information in your account will not completely delete that information from our systems. California residents, subject to verification, may request that we delete any personal information we have collected from them subject to a number of exceptions, including, but not limited to, if the information is necessary for us or our service provider to:

• complete your transaction;

• provide you a good or service;

• protect your security and prosecute those responsible for breaching it;

• fix our system in the case of a bug;

• protect the free speech rights of your or other users;

• comply with the California Electronic Communications Privacy Act (Cal. Penal Code § 1546 et seq.);

• engage in public or peer-reviewed scientific, historical, or statistical research in the public interests that adheres to all other applicable ethics and privacy laws;

• comply with a legal obligation; or

• make other internal and lawful uses of the information that are compatible with the context in which you provided it.

We may need to retain certain records, for example those relating to open orders, payments, or customer service matters, or for legal and accounting purposes. We will respond to a verifiable consumer request for access or deletion in accordance with applicable law. If we require more time, we will inform you of the reason and extension period in writing.

If you are under 18 years of age, reside in California, and have a registered account with us, you have the right to request removal of unwanted information that you publicly post on our website. To request removal of such information, please contact us at help@sundayzglam.com.Upon receiving such a request, we will make sure that the information is not publicly available on our website, but the information may not be completely or comprehensively removed from our systems and databases.

Please note that you may only make a verifiable consumer request for access or data portability twice within a 12-month period.

California law requires website and online service operators to disclose whether third parties may collect personal information about their users’ online activities over time and across different sites when the users use the operator’s website or service. Third parties that have content or services on our Site such as a social feature, analytics service, or an advertising network partner, may obtain information about your browsing or usage habits but this information does not include personal information. We do not knowingly permit such third parties to collect any Personal Information from our Site unless you directly provide it to us and we provide it to them with your consent.

If you are a minor under 18 and have a profile on Sundayz Glam site, you may ask us to remove reviews or other content that you posted on the site by emailing us at help@sundayzglam.com and providing as much detail as possible (i.e. date and caption) as to the post(s) you want removed. We will begin to process your request within 30 days. Please note that processing your request does not ensure complete or comprehensive removal of content that you posted.

22. Security and Retention of Your Information

Please be aware that no security measures are perfect or impenetrable, and we cannot guarantee “perfect security” or “absolute security.” In addition, any information you send to us may not be secure while in transit. We recommend that you do not use insecure channels to communicate sensitive or confidential information to us.

How long we retain your personal information depends on different factors, such as whether we need the information to maintain your account, to provide the Services, comply with legal obligations, resolve disputes or enforce other applicable contracts and policies.

The Sites may contain links to third party sites that are not owned or operated by Sundayz Glam. This includes links from advertisers, sponsors and/or partners that may use our logo(s) as part of a co-branding or co–marketing agreement. We do not control, recommend or endorse and are not responsible for these sites or their content, products, services or privacy policies or practices. These other sites may send their own cookies or other tracking technologies to your device, they may independently collect data or solicit Personal Information and may or may not have their own published privacy policies. You should also independently assess the authenticity of any site which appears or claims that it is one of our Site (including those linked to through an email or social networking page). The Sites may make available chat rooms, forums, message boards, and news groups. Remember that any information that you disclose in these areas becomes public information and is not subject to the provisions of this Privacy and Cookie Notice.

This website is governed by and operated in, and in accordance with the laws of the United States, and are intended for the enjoyment of residents of the United States. Sundayz Glam makes no representation that the website is governed by or operated in accordance with the laws of any other nation. If you are located in the European Union, Canada or elsewhere outside of the United States, please be aware that information we collect may be transferred to and processed in the United States. By using the Site, or providing us with any information, you (a) acknowledge that the website is subject to the laws of the United States, (b) consent to the collection, processing, maintenance and transfer of such information in and to the United States and other applicable territories in which the privacy laws may not be as comprehensive as or equivalent to those in the country where you reside and/or are a citizen, and (c) waive any claims that may arise under those laws.
